Frankfort Man Pleads Not Guilty In Lexington Murder Case

A man charged in a weekend shooting incident that left a man dead and another hurt pleaded not guilty to murder charges in court in Lexington Wednesday.

Police say Dynell A. Stewart, 21, fired shots at a car driving along Bolivar Street near the Tolly Ho restaurant around 2:30 a.m. Sunday morning. Bullets hit the driver and a passenger in the car. A third person in the vehicle was not injured.

One of the men shot, Allen M. Smith, 23, of Lexington was pronounced dead at about 6 p.m. at UK Hospital Monday night.

Police say they obtained a warrant for Stewart, who is from Frankfort, on Monday and arrested him with the help of Frankfort police.

Police said Tuesday that this does not appear to be a random shooting, and that the suspect, Stewart, was in also in a car at the time of the shooting.

The other victim, whose name has not been released, is at UK Hospital listed in serious condition. So far, police have not released a possible motive for the shooting.
