An eastern Kentucky judge has refused to recuse herself in the case of a man accused of manslaughter in the death of a Magoffin County child.
James Garcia, 42, is charged with first-degree manslaughter. His four-year-old son, Cameron Mullins, died of blunt force trauma injuries nearly two years ago.
Garcia's girlfriend was also charged but entered a guilty plea to a lesser charge. Garcia originally tried to enter a plea, but the judge would not accept it.
Now, the judge has 14 days to decide whether to accept Garcia's amended plea.
