LEX 18 has learned that prosecutors in Laurel County have filed to dismiss four of the five charges filed against the school district's director of pupil personnel who was indicted on allegations of sexual abuse.
There is no DNA in the case and now, and no lead witness against Charles Doug Phelps. Phelps was indicted a year ago for allegedly exposing a 14 year-old to sexual contact and giving the teenager alcohol.
The fate of a fifth count is awaiting an opinion from the state supreme court on whether it's constitutional.
