With his trial just ten days away, murder suspect Marty Roe appeared in court for a motions hearing Friday, January 18th.

Marty Roe is accused of murdering Lexington dermatologist Dr. Martha Post in 2011. Police say Roe shot and killed Post outside her Lexington office, Commonwealth Dermatology.

Judge James Ishmael ruled to allow the defense to subpoena business and tax records as far back as 2008 from Post's business, and Summerhill Primary Care LLC, which is where Post's husband, Dr. Robert Truitt works. Those records will be sealed, and are due by Wednesday, January 23rd.

The trial is set for January 28th. A motion for continuance by the defense was denied.
