Prisoner Who Escaped Prison Van In Woodford County In 2010 Sentenced To 51 Months In Prison

The convicted Mafia member who escaped from a prison van in Woodford County in 2010 was sentenced to 51 months in prison Monday.

Derek Capozzi had earlier entered what's called a conditional guilty plea, one where he admits the escape charge, but leaves the door open to appeal two issues.

The first, a ruling on a double jeopardy claim and also the 39-year-old's medical necessity. Capozzi wrote in letters submitted to the judge that he escaped the prison transport van because he wanted to seek help for a hole in his heart.

The Massachusetts prisoner was convicted for the 1996 murder and dismemberment of a 19-year old girl. He was in Kentucky on his way to London to testify in another federal trial when he escaped and was on the lam for three days before he was found in Versailles.

Capozzi is set to serve his sentence in Florence, Colorado. His sentence will be followed by three years of supervised release.
