Dog Found In Hot Car, Man Arrested

LETCHER COUNTY, Ky. (EKB)-- A man convicted for leaving a dog in a hot car in 2014 was arrested for the same exact crime over the weekend.

Clifton Machniak, 57, of Elkhorn City, was arrested Saturday afternoon at the Mountain Breeze Apartments.

Jenkins Police Chief Jim Stephens said a resident at the apartments noticed a dog in the back of Machniak’s vehicle, which was running and had the windows rolled halfway up. The dog was allegedly in distress, panting and trying to escape from the car, which had no air conditioning.

Stephens said when he arrived, he let the dog out of the car, and the dog collapsed onto the pavement. Machniak eventually arrived back to his vehicle, and was arrested on an animal cruelty charge.

Machniak was charged with second-degree cruelty to animals. He was also allegedly found to be in possession of marijuana and brass knuckles, and was charged with possession of marijuana and carrying a concealed deadly weapon. He was lodged in the Letcher County Jail, and has since been released.

According to court documents, Machniak was convicted in 2014 after pleading guilty to an animal cruelty charge after he left a dog in a hot car in Pikeville. He received a probated sentence and was ordered to be subject to random checks from Pike County Animal Control.

In this latest incident, Letcher County Dog Warden Dustin Holland seized Machniak’s dog. Holland told EKB News that the dog is in good condition at this time.
