Man Charged With Violating Graves

WAYNE COUNTY, Ky (LEX 18) The Powell Cemetery has been around since the 1800's and is well-known across Wayne County, but it is no longer owned by the Powell Family. The man who bought the property is facing some serious charges for violating gravesites.

H.M. Powell and his daughter Beverly spent Thursday assessing the damage inside the small cemetery that has been in the family for hundreds of years.

Last week, Powell found at least 18 grave site markers moved, admittedly by the landowner, Donnie Gregory, who has since been charged with 10 counts of violating a grave. 

"I had no intention to hurt any gravesites. I just needed to put up a different fence," said Gregory. He said he will never return to the cemetery.

The Powells didn't believe it was their responsibility to care for the cemetery once the land was sold, nor did they think Mr. Gregory could do as he pleased with it.

"If you buy a piece of property with a cemetery on it, you should be responsible for having it," said Beverly Mikel. 

Powell and his daughter plan to hold Gregory responsible for desecrating the graves belonging to their family members.

"Meant no disrespect to no one.  Just needed some help doing something," said Gregory.

"I accept his apology," said Powell. "I don't want trouble with nobody, but that don't make it right."

They plan to be in circuit court in January to see if the law can make it right. 

Gregory will be back in court in January and plans to enter a not guilty plea on all 10 counts.
