Court Of Appeals Grants Request For Access To Sealed Information In Marshall Co. High Shooting

MARSHALL COUNTY, Ky (WPSD/LEX 18) On Thursday, the Kentucky Court of Appeals granted Paxton Media Group's request for the sealed information in the Marshall County High School shooting that killed two.

Paxton Media Group owns WPSD-TV. The group filed two petitions back in February. WPSD reports that one asked the Court of Appeals to order Marshall County Circuit Court to release the recording of 15-year-old Gabriel Parker's arraignment and allow WPSD access to further proceedings in the case.

The second petition filed sought relief from a gag order and the unsealing of records in the case. It was determined that Paxton Media Group was entitled to access court documents and a recording of Parker's arraignment.

As for the gag order, Judge Glen Acree told the media group that the Court of Appeals cannot review the claim. Instead stating, “we simply remind the Respondent (Jameson) that, not unlike the open hearings and open records protection described in Meigs, there must be a hearing, consideration of less restrictive means, and specific findings before a gag order can be imposed.”

The court ruled that Circuit Judge James Jameson was wrong closing Parker's arraignment, but despite this decision, the Kentucky Supreme Court has denied the Commonwealth's request that a special judge be appointed. 

Parker has been charged as an adult in the case. 

The records unsealed Thursday show that Parker is facing 16 counts in the shooting. Two are for murder and fourteen are for assault 1st degree. On January 23, Parker is accused of firing a handgun into a crowd of people in the commons area of Marshall County High School, killing 15-year-old Bailey Holt and 15-year-old Peston Cope. 

The records also state that a Detective with KSP says that Parker is on video surveillance in the shooting and led detectives to the location of the firearm used in the crime. Detectives are also hoping to tie Parker to the crime using DNA fingerprint evidence, according to the documents.

    LEXINGTON, Ky. (LEX 18)-- Four people were injured in a crash early Friday morning. It happened around 2:30 a.m. on Old Paris Road near Strawberry Fields Road. Police say an SUV went off the road into the grass, took out a tree, and flipped. Three people were ejected, and one person was cut from the SUV.  All adult passengers were taken to the hospital with non-life threatening injuries.
