Governor's Administration Sues Kentucky Public Pension Coordinator Over Open Records Request

FRANKFORT, Ky. (LEX 18) - A coordinator at the Kentucky Public Pension Coalition was served with a lawsuit by Governor Bevin's administration.

According to court documents, a lawsuit was filed against  KPPC’s Coordinator, Ellen Suetholz, who had filed an open record request last year for the release of the PFM actuarial analysis on Governor Bevin’s pension bill.

On February 5, 2018, the Office of the Attorney General for the Commonwealth of Kentucky ruled that the Office of the State Budget Director violated the Kentucky Open Records Act. 

The suit by the Governor's office appeals the Attorney General's decision, by saying that the new bill, SB1 is dramatically different and that the information requested by Suetholz is no longer relevant to the current version of the pension bill. The original analysis was related only to the draft pension bill which the suit calls "preliminary."

The Governor is demanding a reversal of the Attorney General's decision.

“This is really unfortunate that the Bevin Administration has resorted to suing their own constituents to get their way. It’s rather unusual for a Governor to take such a drastic step to prevent disclosure of a taxpayer-funded document. It seems that the Governor and his Administration will go to any lengths to shield any negative news coverage. This has been a complete lack of transparency on their part," said Ellen Suetholtz. 

LEX 18 has reached out to Governor Matt Bevin's office but has not heard back at this time.
