AG Beshear Sues To Stop Pension Law

FRANKFORT, Ky. (LEX 18) — Kentucky Attorney General Andy Beshear made good Wednesday morning on his promise to challenge the new pension overhaul signed into law the day before by Gov. Matt Bevin.

In a tweet sent out just before 11 a.m., Beshear is seeking an injunction to stop Senate Bill 151 from coming into force.

In his filing challenging the new law, Beshear says the pension law is illegal, claiming violates several statutes by changing the terms of the pension contract.

Bevin spokeswoman Elizabeth Kuhn responded after the lawsuit was announced with criticism of Beshear as well as his father, former Gov. Steve Beshear.

“The Beshears have always treated pensions as political currency, so it’s no surprise that Attorney General Beshear filed this political lawsuit today," Kuhn said in a statement. She went on to accuse the former governor of underfunding "the pension system by billions" and the attorney general of pandering to the teachers union.

"Rather than looking out for the best interest of Kentuckians, the Attorney General has chosen a political path, one that will cause irreparable damage to public employees and taxpayers," Kuhn said.

“I don’t think there’s a doubt that the public-pension bill breaches the inviolable contract and is otherwise illegal on multiple fronts, so I am pleased to see the Attorney General’s office join with the Kentucky Education Association and Kentucky FOP Lodge to have it thrown out in court. The House Democratic Caucus is proud to stand with them and will keep working legislatively to do all we can to reverse this law, which will not reduce the unfunded liabilities of the systems over a 30 year period of time and will actually end up costing our taxpayers billions of dollars extra while providing an inferior retirement benefit for public workers," said House Democratic Leader Rocky Adkins.
