LEXINGTON, Ky. (LEX 18) — A Lexington couple is serving 15 years in prison for drug and weapons crimes, but will now get a new trial on one of the charges.
Luis Morales-Montanez and Jessica Acosta pleaded guilty to trafficking in marijuana and cocaine and to possessing guns in connection with the dealing.
However, they have denied all along that they had also dealt meth and went to trial on that charge.
Both were found guilty.
But, the Sixth Circuit Court of Appeals ruled in May that the prosecutor made numerous prejudicial statements during their trial and overturned their conviction on that charge.
All deadlines for re-hearing the case has passed and the case has been returned to the U.S. District Court in Lexington for a new trial.
