FRANKFORT, Ky. (LEX 18) — The Kentucky Supreme Court has overturned the conviction of a Garrard County man serving a 20-year sentence for rape, sodomy and sex abuse.

Matthew Hacker Sr., 51, was convicted last year.

The case involved a girl who was younger than 12 when the alleged abuse occurred.

Hacker challenged his conviction based on faulty jury instructions.

The Supreme Court agreed.

Hacker’s case now will go back to Garrard County for a new trial.
