LOUISVILLE, Ky. (WAVE) — Kentucky's mask mandate went into effect Friday, July 10, but now, several days later, some still question whether the order is legal.
WAVE 3 News in Louisville spoke to two attorneys who say it is legal and constitutional.
One of those attorneys, Michael Abate, compared the mask mandate to a century-old Supreme Court ruling that declared requiring all adults to receive the Small Pox vaccine constitutional.
Attorney Mitchel Denham says the temporary restraining order filed by a Scott County Circuit Court Judge only applies to Executive Orders.
We're told the Governor's mask mandate was an emergency regulation.
