EPO Against Middleton Thrown Out Due To ‘Insufficient Evidence’

LEXINGTON, Ky. (LEX 18)– A judge has thrown out the Emergency Protective Order filed against a Lexington police officer due to “insufficient evidence.”

The District Court Domestic Violence Division confirms Judge Kathy Stein threw out the EPO against Sergeant Jervis Middleton on Thursday.

Middleton is accused of stalking a woman he had been in a previous relationship with.

In addition to filing a complaint with the police department, the woman filed a petition for the EPO against Middleton on Aug. 6.

According to the court, there is no official paperwork associated with the EPO being thrown out.

Middleton is still facing a charge of official misconduct. He will be back in court on that charge on Oct. 1.
