LOUISVILLE, Ky. (WAVE 3) – The family of a Jefferson County Public Schools student suspended for possessing a gun on a school bus is now suing the district.

Phoenix O’Neal, a former sophomore at Male High School, said she briefly took the gun from another student in October to diffuse the situation, and did not put other students in danger.

But JCPS saw it differently, suspending O’Neal for 10 days and transferring her from Male to Minor Daniels, an alternative school.

The lawsuit claims she cannot get a quality education at Minor Daniels, and that the school is not safe.

The family is appealing the transfer, but in the meantime, O’Neal has not been going to any school.

JCPS doesn’t comment on pending litigation.
