LEXINGTON, Ky. (LEX 18)– Three men accused of killing a University of Kentucky student were expected to appear in court Monday for a hearing.

However, they did not make an appearance as the Supreme Court has yet to decide if the death penalty is an option in this case (two of the defendants were over 18 but under 21 at the time of the crime).

Jonathan Krueger, who was the photo editor of UK’s student newspaper, was shot and killed during an armed robbery on East Maxwell back in 2015.

Efrain Diaz, Justin Smith, and Roman Gonzalez are all charged with murder and first-degree robbery.

Smith is also charged with tampering with physical evidence and fleeing police.

A new trial date has been set for Nov. 12 pending the Supreme Court’s decision.
