BOONE COUNTY, Ky. (LEX 18)– A hearing was held Monday in Boone County after a high school senior filed a lawsuit against the health department for keeping him from high school.
18-year-old Jerome Kunkel took the stand and said he does not believe in the chickenpox vaccine because it is against his religion.
His family filed a lawsuit against the Northern Kentucky Health Department after students without proof of vaccination or proof of immunity against the infection were banned from school for 21 days following an outbreak.
Kunkel told the courtroom he has not been to school since the ban was put in place March 15, and couldn’t finish out his senior year of basketball.
He says he has also missed the start of baseball season.
