(OLDHAM ERA) — A former Oldham County High School teacher accused of having sex with a student has filed a motion saying criminal charges against her are unconstitutional.

According to the Oldham Era, Haley Reed, 37, is charged with rape, sodomy and unlawful transaction with a minor for allegedly having sex with a 17-year-old student on multiple occasions.

The encounters allegedly took place on school grounds during school hours. In a motion filed by Reed's attorney, she argues that the student was old enough to give consent, so the charges against her violate her constitutional rights.

She is scheduled to go on trial in November.
