UPDATE: Sept. 19 at 7:40 a.m.
A 20-year-old Lexington man has been charged with first-degree assault after police say he shot someone in the head at a bus stop, leaving the victim in critical condition.
According to the criminal complaint filed in Fayette County District Court, Jon'tay Mattingly was arrested Thursday after investigators used surveillance footage and ankle monitor records to connect him to the Sept. 18 shooting at the intersection of Winburn Drive and McCullough Drive.
The complaint read that officers responded to reports of a gunshot victim at around 11 a.m. The victim was taken to UK Hospital with life-threatening injuries and remains in critical condition.
Police say surveillance video captured two shooters, who came from behind a fruit market, before fleeing toward MLK Park in the direction of Millbank Road after the shooting.
Investigators identified Mattingly as a suspect after reviewing the footage, which showed one individual wearing an ankle monitor and a distinctive gray zip-up jacket with a black stripe across the front and black zipper on the left sleeve, the complaint read.
"Jon'tay Mattingly was arrested on Aug. 1st, 2025 in Fayette County and was wearing the exact same jacket as what is observed on surveillance video, which is captured on Body Worn Camera," the complaint states.
Police discovered Mattingly is currently on probation and wearing an ankle monitor, the complaint noted. Records from Probation and Parole matched the surveillance footage and witness statements about where the suspects fled, according to the complaint.
Mattingly has been charged with first-degree assault and is currently being held on a $85,000 bond.
During a court hearing on Friday afternoon, Mattingly entered a not guilty plea, according to LEX 18 in court.
LEX 18 previously reported that in October 2024, Mattingly was arrested in connection to the shooting death of 17-year-old Kenlon Johnson and he was charged with murder.
A grand jury in Fayette County declined to indict Mattingly in the case and the charge was dismissed, according to court documents.
